Terms of Use

Location when it matters.

The short version

These Terms of Use are an agreement between you and Kymber that governs your use of the Kymber app and related services. By creating an account, or by continuing past onboarding, you agree to them. If you do not agree, please do not use the Service.

Kymber is a personal safety tool — not a replacement for emergency services. We have zero tolerance for harassment and abuse, and we give you in-app tools to block and report anyone who misuses it.

These Terms work alongside our Privacy Policy, which explains how we handle your information.

1. What Kymber is

Kymber is a personal safety tool. It lets you share your location with people you trust, send and respond to location requests, raise an emergency SOS, coordinate meet-ups, set a "check on me" safety timer, share a private board with a small group of your contacts, and send simple private letters and cards ("Envelopes") — with an optional short voice note — to your contacts. Kymber is not a replacement for emergency services. In a real emergency, contact your local emergency number (such as 911) directly.

2. Who can use Kymber

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use Kymber. By using the Service you confirm that you meet this requirement and that the information you provide is accurate.

3. Your account

You are responsible for the activity that happens through your account and for the contacts and content you choose to share. Keep your device secure. Tell us if you believe your account has been misused.

If you choose to turn on the optional linked backup, your Kymber account becomes recoverable through the Google account or Apple Account you link. You are responsible for that account and for keeping it secure — anyone who can sign in to it can recover your Kymber account.

4. User content and acceptable use Zero tolerance

Kymber lets you create and send content to specific people you choose — including Envelopes (letters and cards), voice notes you record, bulletin posts, group posts and comments, meet-up notes, names, messages, and shared locations ("User Content"). You are responsible for the User Content you send.

You agree not to use Kymber to:

We have zero tolerance for harassment and abuse. You should only send Envelopes and location to people who want to hear from you.

5. Blocking and reporting You're in control

Because Kymber lets people send you Envelopes, we give you tools to stay in control:

We review reports and may remove content, warn users, or suspend or terminate accounts that violate these Terms.

6. Enforcement

We may, at our discretion and where appropriate, remove content and suspend or terminate access to the Service for anyone who violates these Terms or applicable law, or to protect the safety of others. Where reasonable, we will aim to act proportionately.

7. Privacy

Your use of Kymber is also governed by our Privacy Policy. Kymber retrieves your location only for a session you start or accept — a live share, an SOS, a meet-up, or a ping. Such a session keeps running when you put your phone away, which is the point of it, and it ends when you end it or when its timer runs out. Outside a session you started, Kymber does not collect your location at all, and it never tracks you in the background on its own.

8. Purchases, subscriptions and refunds

SOS and the core safety features are free forever. They are not behind any purchase, and no lapse, cancellation, or refund ever takes them away from you.

Kymber offers optional purchases — two for yourself, and the same two again as a gift for someone else:

Gifts. When you send a gift you tell us the recipient's phone number, and we deliver the gift to whoever uses Kymber with that number. Three things follow from that, and you agree to them when you buy a gift:

If a gift you paid for cannot be delivered, tell us from the feedback box in Kymber Resources and we will put it right.

Billing and cancellation. All purchases are processed by the app store you downloaded Kymber from — Google Play Billing on Android, or the Apple App Store on iPhone — and never by us; we never see or hold your payment details. Your subscription is managed where you bought it: in your Google Play account on Android, or in Settings under your Apple Account subscriptions on iPhone. That is also where you cancel it. Cancelling stops the next renewal; you keep your membership for the remainder of the period you have already paid for, and we do not pro-rate part-used periods.

Refunds. Because the store takes the payment, the store issues the refund. On Android that is Google Play, under Google Play's refund policy. On iPhone it is Apple, through Apple's Report a Problem process. Either way the refund is subject to that store's terms and time limits. If you believe something has gone wrong with a purchase, contact us at support@kymber.app and we will help where we can, but we cannot issue a store refund on your behalf. Nothing here affects any statutory refund or cancellation rights you have under the law of your country, which continue to apply.

Price changes. If we change the price of a subscription, we will tell you in advance and you will have the chance to cancel before the new price takes effect, in accordance with the rules of the store that bills you — Google Play or the Apple App Store.

9. Service availability

We work to keep Kymber reliable, but we provide the Service "as is" and cannot guarantee it will always be available, uninterrupted, or error-free. Do not rely on Kymber as your only means of getting help in an emergency.

10. Disclaimers and limitation of liability

To the fullest extent permitted by law, Kymber is provided without warranties of any kind, and we are not liable for any indirect, incidental, or consequential damages arising from your use of, or inability to use, the Service. Nothing in these Terms limits any rights you have that cannot be limited by law.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Kymber after changes take effect means you accept the updated Terms.
